Chapter 701- Assignment and Cancellation of Mortgages: Florida is unique in regards to mortgage satisfaction in that its laws are much harsher than other states. If the lender does not issue a satisfaction certificate within sixty days of the final payment of the loan, he/she has committed a second-degree misdemeanor.
Chapter 702- Foreclosure of mortgagee, Agreements for deeds, and Statutory Liens: All foreclosures, except multifamily property of more than four units, are foreclosed judicially, and in equity. The foreclosure takes place in court, and without a jury.
